Ironwall by Incogni Terms of Service

Welcome to Ironwall by Incogni! Please read this information carefully. The Ironwall by Incogni Terms of Service (‘Terms of Service’) govern your access to and use of the website www.ironwall.com (‘Website’) and the Ironwall by Incogni Service (as defined below). This is a binding agreement between 360Civic (‘Ironwall by Incogni’, ‘We’, ‘Us’, ‘Our’, ) and you (‘You’, ‘Your’). IF YOU DO NOT AGREE TO ALL OF THE TERMS OF SERVICE, DO NOT ACCESS OR USE THE WEBSITE OR OUR SERVICE. BY ACCESSING OR USING THE WEBSITE AND OUR SERVICE, YOU AGREE TO BE BOUND BY THE TERMS OF SERVICE.

IF YOU HAVE SIGNED A SERVICE AGREEMENT WITH IRONWALL BY INCOGNI, THE TERMS OF THE SERVICE AGREEMENT ARE INCORPORATED HEREIN BY REFERENCE. IN THE EVENT OF ANY INCONSISTENCY OR CONFLICT BETWEEN THE SERVICE AGREEMENT AND THESE TERMS OF USE, THE TERMS OF THE SERVICE AGREEMENT SHALL PREVAIL.

If You receive an invitation to join Ironwall by Incogni when the organization You are working at (‘Organization’) has entered into a contractual relationship with Ironwall by Incogni to provide You the Service (as defined in detail in Ironwall by Incogni agreement with the Organization).

What is the Ironwall by Incogni Service?

The service (‘Service’) offered by Ironwall by Incogni is the search for and removal of users’ personally identifiable information from the internet and online databases (e.g. people search sites, data brokers, etc.) . Ironwall by Incogni offers this Service to organizations (e.g. judiciary, law enforcement, and business) seeking to protect their employees, members, public servants, etc. and their residing family members.

To provide the Service to You, Ironwall by Incogni may need to show that it is acting as an agent of the Organization, and then on Your behalf. By signing a contract with Ironwall by Incogni, Your Organization has provided Ironwall by Incogni a letter of agency, and Ironwall by Incogni will use that letter on Your behalf to have information removed. A copy of the letter of agency is available from the Organization’s administrative contact.

Depending on Your plan, Ironwall by Incogni may initiate legal action on Your behalf against entities that refuse to remove Your personally identifiable information as required by law. You will be notified and must approve any such action. If legal action is pursued, Ironwall by Incogni will cover all associated costs and split any recoveries with You on a 50/50 basis after costs.

You Will Need to Create an Account to Use the Service

You must create an account to provide Us with the information necessary to receive the Service and Service updates. You are solely responsible for all use of and activity on Your account, including, but not limited to, use of the account by any person who uses Your account, with or without authorization, or who has access to a computer on which Your account is accessible.

To create an account, You must complete the registration process by providing complete and accurate information about Yourself as prompted by the registration form. To register, You must provide an email address, which We will ask You to authenticate. To create an account, You will also need to create a secure password. You are entirely responsible for maintaining the confidentiality of Your password. You may not sell or trade this account to another person.

You agree to notify Us immediately of any unauthorized use of Your account, email address or password. We are not liable for any loss that You or any third party incur as a result of someone else using Your password, either with or without Your knowledge. We reserve the right to terminate Your account at any time.

You are responsible for providing correct information. Nevertheless, You have the option to update the information (except the sign-up email) You provide to Us at any time.

Payment and Cancelation

Your Organization is responsible for all payments and renewals as well as the administration of any issues or changes with Ironwall by Incogni. If the Service is canceled by Your Organization, Your Service will be made inactive, and You will be notified of the reason for termination. Refunds, if any, will be provided to Your Organization.

If You don’t want to receive the Service, You can request to terminate and delete Your account.

Privacy Commitment

We prioritize the privacy of Your information. Our Privacy Commitment:

  • We do not own Your personally identifiable information. It will only be used by Us for the provision of the Service (search, removal, and verification of removals, or to contact You about the status of Services).
  • Upon termination of Your account, for any reason, We will delete Your information.
  • We do not append personally identifiable information to Your account, purchase information from other sources, or otherwise increase the amount of information We store on You.
  • Except as required by law or as needed for Our Service provision, We will not divulge Your information to other entities.
  • Your account displays all the information We have on You at any time.
  • Your Organization may elect an administrator who can view reports on active participants and may view Your personally identifiable information through the Website. Contact Your Organization for their privacy policy and administrator policies.

This policy outlines how We collect and otherwise process personal information. By using the Ironwall by Incogni Service and providing Us with information, You implicitly agree to all actions taken by Us regarding Your personal information in accordance with the Privacy Policy.

Use of the Website

The Website provides information about Our Service, allows registered users to access their accounts, and offers the ability to contact Us for further information or support. You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of anyone else or restrict or inhibit anyone else's use and enjoyment of the Website.

To the fullest extent permitted by applicable law and the contract with the Organization, the Website, the Ironwall by Incogni Service, the documentation, and any product, or other item provided by Us or on Our behalf are presented on an "AS IS" and "AS AVAILABLE" basis. We explicitly disclaim, and You waive, all other warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, as well as warranties arising from course of performance, course of dealing, or usage in trade.
